  • Goods

    The goods namsai.fr has on offer for sale are those that appear on the www.namsai.fr website on the day the internet user consults the site.

    The goods are offered for sale while stocks are available.

    The goods offered for sale are described and presented as accurately as possible. However, Namsaï cannot be held responsible if errors or omissions are made in this presentation. The photographs and copy illustrating the goods are provided by way of information and are not contractually binding.

  • Prices

    Prices are stated in euros (€) and incorporate all taxes including French value-added tax (TVA), however delivery charges will be borne by the internet user unless otherwise stated or special terms apply.

    The prices indicated include the applicable rate of TVA in France on the day of ordering. If the TVA rate is altered, these changes may be applied to the prices of articles without prior notice to the internet customer.

    Namsaï reserves the right to modify its prices at any time. The goods will be invoiced on the basis of the rates applicable at the time the order is registered.

  • Ordering

    All orders placed imply the express and binding acceptance of the prices and descriptions of the goods available for sale.

    The internet user declares that (s)he has read and accepted these terms of sale unconditionally prior to placing all orders. Order confirmation implies acceptance of these sales terms. .

    Namsaï has created approval and acceptance screens to enable its internet customers to have second thoughts about their orders prior to final confirmation. The order will not be irreversibly entered until final validation of the order payment screen (by bank card or cheque). The order is considered to be binding from the final acceptance click. An email is sent to the internet customer once the order has been entered. This email confirms that Namsaï has taken the customer’s order into account and that the merchandise is available.

  • Payment

    Payment is either made online by bank card or alternatively by cheque. The invoice for the goods will be inserted into the package containing the ordered merchandise. In the case of "gift" orders, the invoice will be sent directly to the purchaser.

    Online payment by bank card:
    The following cards are accepted: Visa card, MasterCard, American Express and JCB credit cards.

    The account is only debited by the amount of the ordered merchandise effectively shipped.

    Payment by cheque:
    In the event of payment by bank cheque, the latter must be issued by a bank domiciled in France. The cheque made payable to Namsaï must the reach the following address within 10 working days of order confirmation:

    The order will only be released once the cheque has been cashed.

  • Fighting bank card fraud

    All order data is subject to automated processing. All bank card payments are carried out on a secure site guaranteed by BNP Paribas.

    To avoid any fraudulent use of bank card numbers, Namsaï exercises total freedom to verify personal data provided by customers and take any steps deemed necessary (request of proof or order cancellation) to ensure that the person whose bank account is debited is the very person who placed the order.

    In accordance with the French Act of 6 January 1978 on Data Processing Data Files and Individual Liberties, internet customers have the right to access, correct, and reject all personal data held by writing with proof of their identity to Fia-Net - Service Informatique et Libertés, 22 rue Drouot 75009 Paris, France.

  • Secure bank card payments

    To ensure that payments are secure the www.namsai.fr website uses the secure payment service provided by the BNP Paribas group. This service incorporates the SSL secure sockets layer standard: internet customers’ confidential data (the 16-digit bank card number, expiry date and cryptogram) is directly transmitted to the bank server in encrypted form without being routed via the Namsaï server terminals. This transfer protocol does not support authentication of the bank card holders issuing payment orders.

    Once the order has been confirmed, the payment order is routed in real time to the Merc@net S.S.L. payment orders server that retrieves the element specific to the payment in encrypted form and at the same time recovers the payment order of the customer, and directs it to the telebanking manager.

    The telebanking manager carries out card security checks (such as consulting hot card lists), and on the request for authorisation from the card holder’s bank. Presuming these operations go smoothly, the telebanking manager issues the Acceptance Certificate.

  • Delivery charges, terms and lead times

    Except in the case of force majeure, the indicated delivery lead times only apply to available stocks. Namsaï may not be held liable in the event of delayed delivery, for whatever reason, consequently internet customers may not demand compensation from Namsaï.

    Namsaï reserves the right to choose the transport company and guarantees that the merchandise will be correctly routed.

    Internet customers are responsible for checking the state of the packaging and that the product delivered complies with the order. If necessary they should record any reservations on the delivery note presented by the transport company.

  • Returns and exchanges

    Terms to be observed for returns:

    Internet customers have 10 working days to return articles from the order receipt date. After this period, the delivered merchandise is held to be compliant and accepted by the internet customer, and Namsaï reserves the right to refuse to exchange them, issue a credit note or refund. .

    Returned articles must not have been used, and must be returned in their original packaging. A copy of the delivery note must be included with returns sent through the post together with the reason for their return.

    Internet customers will bear the cost of return postage.

    In that case, an email will inform the internet customer of the refund that will be either by cheque or bank card, depending on the payment method used at the time of ordering.

    The article may either be exchanged or a credit note will be raised redeemable against a future order in line with the customer’s wishes.

  • Intellectual property

    All the elements on the Namsaï website be they visual or audible, including the underlying technology, are protected by copyright, brands or patents.

    They are the exclusive property of the O’JADE Company.

    Any user who has a personal internet website wishing to place a single link, for personal use, on his/her website that directly hooks up to the Namsaï website home page is obliged to request authorisation to do so from the O’JADE company. However this authorisation does not imply any affiliation agreement.

    On the other hand and in any event, hyperlinking to the Namsaï website primarily using framing, deep-linking, in-line linking technique or any other deep-linking techniques is formally prohibited. Any link, even when tacitly authorised, must be removed whenever requested by the O’JADE Company.

  • Liability

    The O’JADE company is under the sole obligation to exercise due care in all the stages of access to the Namsaï website, from the ordering process to delivery or follow-up des services. O’JADE cannot be held liable for any inconvenience or damage inherent in the use of the Internet network – primarily interruption of service, external intrusion or the presence of computer viruses or for any act that qualifies as force majeure, according to jurisprudence.

    Furthermore, Namsaï is free of liability for any omission in its contractual obligations in the event of a force majeure or fortuitous event, including and not exhaustively, internal or external strike, fire, catastrophe, internal or external breakdown, and generally any event preventing the proper fulfilment of orders.

  • Severability

    If any of the clauses of the present contract be held to be null and barred by a change in legislation, regulation or court decision, the validity and observation of these terms of sale will in no way be affected.

  • Period

    These terms apply throughout the period that Namsaï offers these services on line.

  • Applicable law - Disputes

    These terms of sale are subject to French Law. The competent court in the event of a dispute shall be that of the domicile of the defender, the effective place of delivery.

    In the event of a dispute arising from the present contractual relationship, the internet customer and the O’JADE Company will undertake to seek an out-of-court settlement before embarking on any court action.
